Service Agreement Terms: This Alertron Membership Agreement is a legal contract between you and Alertron. The agreement governs your purchase and use of the various online services. Your use of the Services is conditional on your acceptance of this Agreement. By using any service or by checking the acceptance box at the end of this agreement, you accept and agree to be bound by all the terms and conditions of this agreement, as well as any additional terms specific to the particular services for which you register. Authorization: By using our services, you agree that you own or have written authorization to use our service from the legal owner of the URL(s) or IP address(es) to be monitored by Alertron. Modification of Terms of Service: Alertron may amend or modify these terms and conditions at any time. By using our service, you agree to be bound by these Terms of Use as in effect from time to time. Please review these terms and conditions regularly. Your continued use of the Service after notice of any changes to the Terms of Service will be deemed to be your agreement to the amended Terms of Service. Free Trial Service: The free trial program allows you unlimited use of most features of our services for 30 days with no obligation to pay. Free trial accounts cannot be monitored more frequently than every 10 minutes and only email notification is allowed. Free trial accounts can be upgraded at any time during the trial period to remove the trial limitations. If an account is upgraded before the trial period ends, the account will be billed a pro rata amount to cover the rest of the month. Service Fees: Monthly fees are automatically billed to the credit card on file on the first day of each month to cover service for the previous month. All fees are in US Dollar. Service charge is based on number services and type of services. Other fees such as the per incident charge for phone and sms text notification methods will be accumulated during the month. You are responsible for paying your monthly service fee if your service is suspended for nonpayment. Late payment may subject to service interruption until payment is paid in full. Free Service: By using our free monitoring service, you agree not to register for more than one account and you agree to link http://www.alertron.com on your index page or your main page of the website which is being monitored. Free accounts cannot be monitored more frequently than every 30 minutes and only email notification is allowed. Account Cancellation: Service charge is billed on a monthly basis with no contract required. The account can be cancelled at anytime as you wish. DISCLAIMER OF WARRANTY: ALERTRON DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, INFORMATIONAL CONTENT, OR NONINFRINGEMENT. IN NO EVENT SHALL ALERTRON BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF DATA, USE, PROFITS, OR OPPORTUNITY, AND THE COSTS OF SUBSTITUTE SERVICE OR DAMAGES RESULTING FROM A THIRD PARTY'S UNAUTHORIZED USE) RELATED TO, OR ARISING FROM, USE, MISUSE, OR INABILITY TO USE THE SERVICE, REGARDLESS OF WHETHER OR NOT THE PROVIDER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. THE FOREGOING LIMITATION APPLIES TO CLAIMS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), LIABILITY, OR ANY OTHER LEGAL THEORY. SOME JURISDICTIONS DO NOT ALLOW LIMITING LIABILITY FOR CERTAIN DAMAGES. IN SUCH JURISDICTIONS, ALERTRON'S LIABILITY SHALL BE LIMITED TO THE EXTENT PERMITTED UNDER LAW.
